Terms & Conditions

Based on years of experience, we've created these policies to give the best possible communication, service, and experience while helping to prevent potential misunderstandings.  We want our clients to have a most successful and memorable event.

Agreement/Contract/Invoice:
The email that has your event details and pricing will serve as our Agreement, Contract, and Invoice, unless accompanied by a separate Agreement, Contract, or Invoice.  By making a payment, you agree to the terms within the email or separate Agreement, Contract, Invoice and this set of Policies.  If we agree to modify these policies in any way, we shall do so in writing.  


Booking/ Deposits:
We require a 50% deposit to book and hold a date. Once that deposit is received, your timeslot will be blocked out and made unavailable to other parties.  Please note -- When you make a deposit payment you agree to these terms.
- We accept all major credit/debit cards to instantly book. There is an additional 3% convenience fee for using cards.
- We also accept cash or check to avoid any card fee, but the date will not be booked until we receive the deposit funds.


Cancellations:
If we need to cancel: In the unlikely event that we must cancel for something on our end (due to truck mechanical issues, meteors falling through our roof, employees getting abducted by aliens, etc.), we will certainly refund your deposit.

If you need to cancelOur general policy for cancellation is no refunds.  There are two major factors for this policy.  1) When we book a date, that date is no longer available to anyone else that would otherwise have booked it, which results in us turning down other business in order to serve you. 2) Our costs of doing business (office, sales, overhead, food processing, etc.) are spread out over the entire year, not just during our seasonal (May-August) heavy serving months.  This means that a large part of costs associated with the business and any event we cater have already been expended even before an event is worked.
The exception to our refund policy is if we can rebook a date that someone would like to cancel, we can refund up to 100%, depending on the circumstances.


Final Payment:
Michigan Residents: The final balance will be owed before service on the day of the event. 
All other 49 states' residents: The final balance will be due 1 week before your event's date. If paying by check, please send at least 2 weeks (or more) prior to your event to ensure payment is received in time.
- We accept all major credit/debit cards. There is an additional 3% convenience fee for using cards.
- We also accept cash or check to avoid any card fee.


Rescheduling:
Same policy as cancellations. We treat rescheduling as a cancellation and new booking. If we are successful in filling your original spot, we can refund that original deposit.


Price Increase:
Our current prices are subject to change at any time due to market conditions (such as overhead, food, labor and fuel costs).   As part of our contract you agree that we reserve the right to raise our prices up to 10% if needed.  If it is higher than that you will have the option of canceling with a full refund on your deposit. If there is a price increase, we will notify you via email.

Price increases are more probable when an event is booked far in advance.  When a booking is made further in advance (one year away for example), we do our best to anticipate the rise in prices and quote it accordingly to help prevent any price increase.

If in the off chance of an incorrect price on a quote, you will be notified by email or phone, and given the option to accept the corrected price or cancel your service.


Email & Communication:
We use email as our main method of contact and to make agreements. Because of this, all information must be confirmed in writing by email to be valid.  Please keep all email communications within the same conversation thread for the best possible service.  This can be done by simply clicking "Reply" rather than generating a new email.  We will not be held responsible for miscommunications made through individual emails that are separate from the conversation thread.

- PEASE DO NOT ALTER ANY PREVIOUS EMAIL CORRESPONDENCE, as they will automatically revert to the original email content with your changes being lost.  This is done for fraud prevention (an example is filling in answers to questions in an email that was previously sent).  You may instead copy and paste the info which you would like to use in your new email reply. 
- Texts & Phone Calls can also be used for communication, although it is always best to ensure that any important details or updates which need to be documented are followed up via email.  
- Please do not communicate through Social Media, as response times may be delayed.


Minimums Charges: 
Saucy Joe's Italian Food Truck and Good Vibrations Gelato Truck have minimum charges which can vary based on date, time, and various factors, regardless of how small an event may be. 


Headcount:
The terms headcount, number of guests or people refer to the number of servings. A guest getting seconds would be considered a serving. 


Gratuity:
Unless stated otherwise in our agreement, gratuity is not included in our pricing.


Additional Insurance Requirements: 
Some parks and venues require certificates of insurance or have additional insurance requirements. It will be your responsibility to find out what is needed prior to booking us.  -If an insurance certificate is needed, please notify us at least two weeks in advance of the event so we can provide it timely.  There is no charge for this.  
-If there are any additional insurance fees, they will be added to your bill.   We are not responsible for any service issues as a result of not being notified of any special insurance requirements prior to booking.  You will still be obligated to the original agreement and payment.  

City Parks, in our experience, are the ones who have special insurance requirements.


Our Service:
Service is done completely from our trucks. We do not provide any table service. Guests will be expected to come up to the truck to place their orders and will be served from the truck.

We will commence service at our start time and stop service at our end time.  To ensure all orders are served by the end time, we will stop taking orders prior to the end time.  The actual time we stop taking orders is dependent on whether the order can be fulfilled by the end time.  It's important for you and our staff to keep good communications during the event to ensure that we get everyone served before the end time.  When we're 30-45 minutes from the end, we can assess what's going on and make judgement calls. 

If we start serving earlier that our agreed upon start time, we will still serve until our agreed upon end time.


Parking/ Dimensions:
Where the truck can fit and what surface it can drive on will come down to the driver's discretion on site.   

Saucy Joe's Truck: We are 42' long, 10' high and 9' wide and will need to park on even, solid ground. The truck will need enough room to maneuver and pull in/out of the parking spot and can not travel in any area lower/narrower than these dimensions. This includes tree branches and bushes. 

Good Vibrations Truck: The dessert truck is a full-size van, measuring about 19' long, 9' tall, and 8' wide. We will need a fairly level parking spot, with enough room to maneuver in and out of that space.

- We will not park or drive on another private property without notarized, written consent from the owner stating it is okay.  They must agree that we will not be responsible for damage caused by the truck. We do not drive on wet or soft ground. If it has been particularly wet, please have an area on dry, solid ground available for the truck(s).
- Areas with too steep of a grade can cause us to "bottom out" and prevent access to your desired parking area. 
- Please have a contingency plan for a runner up parking spot if your first choice can not be accessed.
- Where the truck(s) can or cannot fit will be at our discretion.
- Ensure that the pathway to our spot is clear to prevent delays in set up and serving.  We will generally not be able to extend our service end time if our start time is delayed due to inaccessible parking.
-We are not responsible for parking spots that are inaccessible.  Your agreement terms still apply.


Electrical Requirements:
We supply our own power generators, and although there is noise from them, it is generally the fastest and easiest way to go.

If you need us to use your energy supply, one of the following configurations will work:
- Qty 3     120v, 15/20 amp circuits with 5-15r or 5-20r outlets
- Qty 1     240v, 30amp circuit with L14-30r outlet
- Qty 1     240v, 50amp circuit with 14-50r outlet
Other possibilities with adapters.  Minimum 30 amp/240v or 60 amp/120v should work.  Each circuit should be dedicated to our truck to eliminate outages.

Please note: We would require these exact specifications and cannot plug into any homemade type devices. If we are unable to use your electrical connection, we will use our generators.  We shall make the final decision if we're able to use your supplied power. If damage is done to our equipment because of an improper electrical supply, the client is responsible for repair or replacement costs.


Change of Details:
We ask that any changes of service times, location, menu, or headcount be made no less than 2 weeks before your event to ensure we can accommodate the update and make the necessary changes on our end.  We understand that sometimes guests are added at the last minute.  Please contact us as soon as you know of any changes if we're less than 2 weeks away from your event.

For changes in time or location, we will do our best to fit in your new time or a different location, providing it does not interfere with another party before or after yours.  If we are unable to accommodate your requested changes, you are still obligated to the original agreement.


Trash Removal:
We do NOT provide trash cans or any trash removal service for guests' emptied plates. We also do not provide bussing or table clean-up service. Please have garbage bins available for plates and such.


'Leftovers':
We don't have leftovers per se, since we do not make trays of food or items in advance, as they are made to order.  Otherwise you would not get the large menu selection we offer. We do make up some items in advance to help serving go quickly, and quite often we have prepared menu items at the end of service.  If you are under on your serving numbers, we will give you menu selections that we already have made up, and we also try our best to approximate what might be able to be made up and left with you at the end of service.  This can be tough to estimate, because we have no idea who is going to come up last minute to place a last call order.

Please understand, we are under no obligation to sort through what was and was not served to try and make a bunch of meals at the end of service, but we try to do what we can to leave you with food if you are under.


Menu Substitutions:
Due to market conditions and situations beyond our control, there may be times when certain items are unavailable or unacceptable.  We reserve the right to substitute menu items, ingredients, serve ware, etc. when the original/advertised item is unavailable or unacceptable.


Allergens:
We will not guarantee that any of our foods have not been in contact with any allergen of any kind.  It is up to the client or guest to decide if he/she wishes to eat from our truck. 


Disputes:
If a dispute arises from our agreement client agrees to first attempt to resolve with us, then mediation, then finally arbitration.  If we must litigate due to non-payment, you agree to all attorney and legal fees to enforce our agreement.  Any action will be filed in Michigan follow the laws of the State of Michigan.
